withSimplicity Affiliate Program Terms & Conditions

Thank you for partnering with withSimplicity (“withSimplicity, LLC”). These Affiliate Program Terms & Conditions (“Agreement”) govern your participation in our affiliate program (“Program”). By joining or continuing to participate in the Program, you agree to be bound by this Agreement in full.

withSimplicity reserves the right to update or modify these Terms at any time. Continued participation in the Program after any changes constitutes your acceptance of the revised Terms.

1. Eligibility

To participate in the Program, you must:

Be at least 18 years of age
Have an active and publicly accessible social media presence, blog, or platform with genuine, engaged followers
Align with the withSimplicity brand values: clean, toxin-free, fragrance-free, and cruelty-free beauty
Comply with all applicable laws and regulations, including FTC disclosure requirements for sponsored content and affiliate relationships

withSimplicity reserves the right to accept or decline any affiliate application at its sole discretion.

2. Affiliate Codes & Links

Upon acceptance into the Program, you will receive a unique affiliate discount code and/or tracking link (“Affiliate Code”). Your Affiliate Code is personal to you and may not be:

Shared with third parties for personal financial gain outside of standard content promotion
Posted on public coupon or deal-aggregator websites without prior written approval from withSimplicity
Used in paid advertising campaigns without prior written approval
Transferred, sold, or assigned to any other individual or entity

You are responsible for all activity associated with your Affiliate Code.

3. Commission Structure & Payments

Affiliate commissions are calculated on qualifying sales generated through your unique Affiliate Code or tracking link, less any refunds, returns, or chargebacks. The current commission rate and discount structure are communicated to you at the time of acceptance and may be updated by withSimplicity at any time with reasonable notice.

Commission payments are issued on a schedule determined by withSimplicity. We reserve the right to withhold commission payments pending investigation of any suspected policy violations. Commissions are not earned on:

Self-purchases (orders placed by the affiliate using their own code)
Orders that are subsequently returned, refunded, or charged back
Orders flagged as fraudulent or in violation of these Terms

4. Prohibited Conduct

The following conduct is strictly prohibited and may result in immediate removal from the Program, forfeiture of unpaid commissions, and recovery of previously paid commissions:

Consistent Self-Purchasing. You may not use your own Affiliate Code to purchase products for yourself, family members residing in your household, or any person acting on your behalf. withSimplicity actively monitors order data and cross-references customer names and email addresses against affiliate account information. Any order placed using your Affiliate Code where the purchaser is identified as you will be deemed a self-purchase. Commission on self-purchases will not be paid, and any commission already paid on such orders may be recovered.
Fraudulent Activity. Any attempt to artificially inflate conversions, traffic, or commissions through fraudulent, deceptive, or automated means is prohibited.
Misrepresentation. You may not make false, misleading, or unsubstantiated claims about withSimplicity products. All content must comply with FTC guidelines and include clear, conspicuous disclosure of your affiliate relationship (e.g., #ad, #affiliate, or equivalent language).
Disparagement. You may not publish content that is harmful, defamatory, or damaging to withSimplicity, its founder, staff, products, or brand reputation.

5. Performance Standards & Program Removal

Participation in the withSimplicity Affiliate Program is a privilege, not a guarantee. We are committed to maintaining an active, engaged affiliate community that genuinely supports and promotes our brand. To that end, withSimplicity reserves the right to remove any affiliate from the Program at its sole discretion, including but not limited to the following circumstances:

Inactivity. If your Affiliate Code has generated zero qualifying orders within any rolling 180-day period, withSimplicity may remove you from the Program without prior notice. Inactivity is defined as no verified conversions attributed to your Affiliate Code during that period.
Failure to Promote. If you have not published content featuring withSimplicity products or your Affiliate Code within a reasonable timeframe, or if your promotional activity appears to have ceased entirely, withSimplicity may terminate your participation.
Self-Purchase Only Activity. If all or the majority of conversions attributed to your Affiliate Code are determined to be self-purchases (orders placed by you or on your behalf), withSimplicity will remove you from the Program. This is not a legitimate use of an affiliate relationship and misrepresents the nature of your audience’s purchasing behavior.
Policy Violations. Any violation of these Terms, including but not limited to prohibited conduct described in Section 4, may result in immediate termination.
Brand Misalignment. If your content or public conduct becomes inconsistent with the values of withSimplicity — including promotion of products or practices that conflict with our clean beauty mission — we reserve the right to end the partnership.

withSimplicity will make reasonable efforts to notify affiliates of performance concerns before removal, but is not obligated to do so in cases of fraud or serious policy violations. Upon removal, your Affiliate Code will be deactivated and any unpaid commissions will be reviewed before payment.

6. Intellectual Property

withSimplicity grants you a limited, non-exclusive, non-transferable license to use our brand name, logos, and approved product imagery solely for the purpose of promoting the Program in accordance with these Terms. You may not alter, modify, or create derivative works from our brand assets. This license is revocable at any time.

You retain ownership of your original content. However, by tagging or mentioning withSimplicity in your content, you grant us a non-exclusive, royalty-free license to reshare or feature your content for marketing purposes, with appropriate credit.

7. FTC Disclosure Requirements

All affiliate content must include clear and conspicuous disclosure of your material connection to withSimplicity. This includes, but is not limited to:

Using #ad, #affiliate, #sponsored, or “I earn a commission on purchases made through my link” in any post, story, video, or blog that features your Affiliate Code or link
Placing disclosures at the beginning of the content where they are immediately visible — not buried in hashtags or below a “read more” break

Failure to comply with FTC disclosure requirements is a violation of these Terms and may result in removal from the Program.

8. Term & Termination

This Agreement is effective upon your acceptance into the Program and continues until terminated by either party. You may withdraw from the Program at any time by contacting us at marketing@withsimplicitybeauty.com. withSimplicity may terminate this Agreement and your participation in the Program at any time, for any reason, with or without notice.

Upon termination:

Your Affiliate Code will be deactivated immediately
Any commissions earned on qualifying orders prior to termination will be reviewed and paid out on the standard schedule, minus any adjustments for self-purchases, returns, or violations
All licenses granted under this Agreement will end

9. Limitation of Liability

withSimplicity makes no warranties, express or implied, regarding the Program, including expected earnings or commission amounts. In no event shall withSimplicity be liable for any indirect, incidental, or consequential damages arising out of your participation in the Program.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia. Any disputes arising under this Agreement shall be resolved in the appropriate courts located in Rockingham County, Virginia.
